TN Now Boasts A Broader Right to Abortion than Roe v. Wade or the US Constitution

Because of a radical 4-1 ruling by the Tennessee Supreme Court in 2000, Tennessee now boasts a broader right to abortion than that recognized by Roe v. Wade or the United States Constitution. 

Basic commonsense protections passed by the Tennessee General Assembly to protect the health and safety of women and girls considering abortion were struck down as violating this newly discovered “right to abortion” within the Tennessee Constitution

Four Tennessee Supreme Court justices stated in Planned Parenthood of Middle Tennessee v. Sundquist, “We specifically hold that a woman’s right to terminate her pregnancy is a vital part of the right to privacy guaranteed by the Tennessee Constitution…and is therefore fundamental.  Accordingly, the statutes regulating this fundamental right must be subjected to strict scrutiny analysis.”

As a result of this pro-abortion ruling, Tennesseans can no longer enforce common sense protections for abortion-vulnerable women or unborn children.

According to the 1 dissenting justice, “the effect of the Court’s holding today is to remove from the people all power, except by constitutional amendment, to enact reasonable regulations of abortion.”

Amendment 1 will restore the ability of citizens and elected officials to decide Tennessee’s abortion policies and restore our Tennessee Constitution towards LIFE.
