Amendment 1 Language Added to Tennessee's Constitution

Part 1

"Nothing in this Constitution secures or protects a right to abortion ….”

  • This clause restores the TN Constitution to where it was prior to the 2000 TN State Supreme Court decision by making our constitution neutral on the question of abortion.
  • Abortion is not banned.  Abortion remains legal across the U. S. due to Roe v. Wade.

 

Part 2

"Nothing in this Constitution … requires the funding of an abortion….”

  • The TN Constitution is now again neutral on the question of tax-payer funding of abortion.

 

Part 3

”….. The people retain the right through their elected state representatives and state senators to enact, amend, or repeal statutes regarding abortion, including, but not limited to, circumstances of pregnancy resulting from rape or incest or when necessary to save the life of the mother.”

  • This restores the TN Constitution to where it was prior to the 2000 TN State Supreme Court decision by placing regulation of abortion back into the hands of the people through their elected representatives.

 

Full amendment language: 

“Nothing in this Constitution secures or protects a right to abortion or requires the funding of an abortion. The people retain the right through their elected state representatives and state senators to enact, amend, or repeal statutes regarding abortion, including, but not limited to, circumstances of pregnancy resulting from rape or incest or when necessary to save the life of the mother."
