TRUE OR FALSE: ABORTION FACILITIES IN TENNESSEE ARE REQUIRED TO BE LICENSED?

Pro-abortion opponents continue to wrongly claim that abortion facilities in our state are, without exception, licensed and inspected. 

While it is true that some willingly submit to licensure, there is no longer a legal basis for requiring such facilities to do so. 

Relying on Planned Parenthood of Middle TN v Sundquist as precedent, in 2002 the TN Court of Appeals ruled in favor of the owners of two busy abortion facilities and struck down the state law requiring licensure of such businesses in our state. http://www.tncourts.gov/sites/default/files/OPINIONS/TCA/PDF/024/BoyleGC.pdf

As a result, half of those businesses in Tennessee which advertise and provide abortion services, are not licensed by the Tennessee Department of Health.
